APN is a brand operated by Virtus Ventures BV ("Company," "we," "us," or "our").
These Terms of Service ("Terms") govern your access to and use of the website https://athleteperformance-nutrition.com (the "Site"), and your purchase of any products sold by us through the Site (the "Products"). The Site and Products are operated by Virtus Ventures BV under the brand "APN."
By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Return & Refund Policy, which are incorporated into these Terms by reference. If you do not agree, do not use the Site or purchase our Products.
We may update these Terms from time to time. The version in force is the one published on the Site at the time you place your order. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) to purchase Products. By placing an order you represent and warrant that you meet this requirement and that all information you provide is accurate and complete. Our Products are intended for healthy adults and are not intended for use by minors, by pregnant or breastfeeding women, or by persons with a medical condition without prior consultation with a qualified healthcare professional.
The following disclaimers apply to all Products and to all content on the Site.
Information provided on the Site, on Product packaging, or in our marketing is for general informational purposes only and is not medical, nutritional, or professional advice. It is not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult your physician or another qualified healthcare provider before starting any supplement, particularly if you are pregnant, breastfeeding, taking medication, have a known medical condition, or are under the care of a healthcare professional.
These statements have not been evaluated by the Food and Drug Administration. These Products are not intended to diagnose, treat, cure, or prevent any disease.
Individual results vary. We make no guarantee that any Product will produce any particular athletic, golf-performance, physiological, or health outcome. Any testimonials, reviews, or examples reflect individual experiences and are not a promise of results.
It is your responsibility to read the full ingredient and allergen information on the Product label before use, and to confirm the Product is suitable for you. Discontinue use and seek medical attention if you experience an adverse reaction. If you have allergies or intolerances, do not use a Product unless you have confirmed its ingredients are safe for you.
If you compete in any sport governed by an anti-doping authority (e.g., WADA, USADA, national federations), you are solely responsible for verifying that a Product and its ingredients are permitted under the applicable rules. We do not warrant that any Product is free from substances that may be prohibited in your sport, and we accept no liability for any sanction, disqualification, or loss arising from your use of a Product in a competitive context.
Our Products are tested under the Kölner Liste® / Cologne List® anti-doping program. Testing under that program screens for substances on the relevant doping lists at the detection thresholds applied by the program and is not an absolute guarantee that a Product is free from all prohibited substances. Section 3 ("Sport and competition") continues to apply.
We try to display Product descriptions, images, and ingredient information as accurately as possible. We do not warrant that descriptions, colors, or other content are error-free, complete, or current. Packaging and formulations may be updated; the information on the physical label supplied with your Product governs.
All orders are an offer by you to purchase a Product subject to these Terms. We reserve the right to accept or decline any order at our discretion, including where the Product is out of stock, where there is an error in pricing or description, or where we suspect fraud or a breach of these Terms.
A contract of sale is formed only when we send you an order confirmation or dispatch the Product, whichever is later. Until then, no contract exists.
Prices are shown in Euro (EUR) and are subject to change without notice, except that changes will not affect orders we have already confirmed. Unless stated otherwise, prices include applicable taxes and duties, and exclude shipping, which is calculated and displayed at checkout.
You authorize us (or our payment processor) to charge your chosen payment method for the total order amount. If your payment cannot be processed, your order will not be fulfilled. You are responsible for any bank, card, or currency-conversion fees charged by your provider.
If a Product is listed at an incorrect price or with incorrect information due to an error, we may cancel or refuse any order placed at the incorrect price, even after the order is confirmed, and will refund any amount already charged.
Shipping times and costs are shown at checkout and are estimates only. Title and risk of loss pass to you upon delivery to the carrier, except where mandatory consumer law in your jurisdiction provides otherwise (for example, in the EU, risk passes to a consumer on physical delivery to the consumer).
For international shipments, you are the importer of record and are responsible for any customs duties, import taxes, and charges levied by the destination country, as well as for ensuring the Product may lawfully be imported and used in your country. We are not responsible for delays caused by customs or for Products seized or refused entry by local authorities. We do not refund duties or taxes paid to third parties.
It is your responsibility to confirm that our Products and their ingredients are legal to import and consume where you live. Some supplement ingredients are restricted in certain countries.
Our return and refund terms are set out below and also form part of these Terms.
We have a 14-day return policy, which means you have 14 days after receiving your item to request a return. To be eligible for a return, your item must be in the same condition that you received it — unopened and unused, and in its original packaging. You'll also need the receipt or proof of purchase.

If your return is accepted, we'll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted. You can always contact us for any return question at info@athleteperformance-nutrition.com.
Please inspect your order upon reception and contact us immediately if the item is defective, damaged, or if you receive the wrong item, so that we can evaluate the issue and make it right.
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.
If you are a consumer in the European Union, you have the right to withdraw from your order within 14 days of receiving it, for any reason and without justification. To exercise this right you must inform us of your decision by a clear statement (for example, an email to info@athleteperformance-nutrition.com); you may use the model withdrawal form, but it is not obligatory. You must return the goods within 14 days of notifying us. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
We will notify you once we've received and inspected your return, and let you know whether the refund was approved. If approved, you'll be automatically refunded to your original payment method within 10 business days. Please remember that it can take additional time for your bank or credit card company to process and post the refund. For EU withdrawals under Section 6.4, we will reimburse you within 14 days of being informed of your decision to withdraw, although we may withhold reimbursement until we have received the goods back or you have supplied evidence of return, whichever is earlier.

For health, hygiene, and safety reasons, supplements that have been opened, used, or whose seal is broken cannot be returned unless they are defective, damaged, or not as described, or unless mandatory consumer law in your jurisdiction requires otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer in your country (including, in the EU, your rights under consumer-protection law, and in the US, any applicable state consumer rights).
All content on the Site — including the "APN" name and logo, text, graphics, product imagery, branding, designs, and software — is owned by or licensed to Virtus Ventures BV and is protected by intellectual-property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any of our content, or use our trademarks, without our prior written consent. Nothing on the Site grants you any license or right to our intellectual property except the limited right to view it for your personal, non-commercial use.
You agree not to use the Site or Products: for any unlawful purpose; to resell Products without our written authorization; to infringe our or any third party's rights; to introduce malware or attempt to gain unauthorized access to our systems; to scrape, copy, or harvest data; or to post unlawful, defamatory, or misleading content. We may suspend or terminate your access if you breach these Terms.
If you submit reviews, comments, images, or other content to the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with our business. You represent that you own or control the rights to the content you submit and that it is accurate and does not violate these Terms or any law. We may remove any content at our discretion.
Except for the supplement-specific disclaimers in Section 3 and to the fullest extent permitted by applicable law, the Site and Products are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
This Section does not exclude or limit any warranty or right that cannot lawfully be excluded or limited, including mandatory consumer guarantees in the EU, the US, and other jurisdictions.
To the fullest extent permitted by applicable law, Virtus Ventures BV and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or Products.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to a Product or order is limited to the amount you paid for the Product giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law (including a consumer's non-waivable statutory rights and any liability for defective products under applicable product-liability law).
You agree to indemnify and hold harmless Virtus Ventures BV and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Products, or your violation of any law or third-party right. This Section does not apply to the extent a loss results from our own breach or negligence, or where it would conflict with mandatory consumer law.
These Terms and any dispute arising out of or in connection with them or your purchase of Products are governed by the laws of Belgium, without regard to conflict-of-law rules.
Subject to any mandatory rights of consumers to bring proceedings in their country of residence, you and we agree to submit to the exclusive jurisdiction of the courts of Antwerp, Belgium.
EU consumers: Nothing in this Section deprives you of the protection of the mandatory consumer-protection laws of your country of residence, and you may bring proceedings in the courts of your home country.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, pandemics, strikes, supplier or carrier failures, or interruptions to power, internet, or payment systems.
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce any provision is not a waiver of our right to do so later.
These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Virtus Ventures BV regarding the Site and Products, and supersede any prior agreements.
